Seventeen states use a version of EVV for some or all of their personal care service prior to the 21st Century Cures Act mandate. We have included programs below that have been in place prior to the federal mandate. Those programs may or may not meet federal requirements for EVV.

On October 1, 2017, the Alabama Medicaid Agency implemented an Electronic Visit Verification and Monitoring (EVVM) system to monitor visits to Home and Community Based Waiver Services clients.

Texas

Texas has been using EVV for most of their Medicaid-provided personal care services and home health care services since March 2015 under state law. It is unknown if their current system meets federal requirements.

Virginia

EVV Frequently Asked Questions for Virginia (March 2018)

“The implementation of EVV in Virginia is ongoing. The Department of Medical Assistance Services encourages health plans and fee-for-service providers to stay informed about the requirements and expectations for implementing EVV. There are several things that you can do now: 1) Educate yourself about the commercial EVV systems on the market; 2) Inform your company or the individual that bills for services that the seven data elements listed above will be required to be submitted with each billing claim; and 3) Begin to develop information to share with the member’s caregiver about EVV based on your EVV system. The individual receiving services and supports and the caregiver should be informed about EVV.”

EVV will not be required for individuals in a group home licensed by the VA Department of Behavioral Health and Developmental Services (DBHDS), a sponsored residential home, the REACH Program, or in a school where the personal care is tied to an Individualized Education Program (IEP).
